Understand when information is educational, when an opinion is preliminary, and when a formal NDS engagement begins.

Important: This policy is intended to describe NDS practices and allocate responsibilities. It is not legal advice. NDS should have Canadian counsel review it periodically and whenever its services or data practices change.

1. General information only

Website pages, blog posts, taxpayer guides, FAQs, calculators, checklists, newsletters, presentations, messages and other public materials are general educational information. They are not tax, legal, accounting, audit, assurance, investment, financial, immigration or other professional advice, and are not a substitute for advice based on your facts.

2. Opinions and preliminary communications

Comments made during an introductory call, inquiry response, email exchange or other preliminary communication are indicative only unless NDS expressly delivers a final written opinion under an accepted engagement. Oral or informal comments may omit qualifications, assumptions, jurisdictional differences or later developments and should not be relied upon as a formal opinion.

3. No professional relationship

Use of the website or portal, submission of information, document upload, booking, payment inquiry or receipt of a response does not by itself create a professional, fiduciary or lawyer-client relationship. NDS accepts an engagement only in writing after scope, responsibility, conflicts, identity, fees and other applicable conditions are settled.

4. Legal services

NDS Consulting is not presented as a Canadian law firm and does not provide legal representation merely through this website. Content about law, compliance, contracts or regulation is business information only. Obtain advice from a lawyer licensed in the relevant Canadian province or other jurisdiction before relying on a legal interpretation or taking legal action.

5. Tax and accounting matters

Tax results depend on complete facts, residency, dates, elections, documentation and changing law and administrative practice. Calculators and estimates may omit credits, surtaxes, provincial rules, instalments, penalties and special circumstances. They are not filing results, fee quotes or guarantees.

Nothing on the site is an audit, review or assurance engagement or opinion. Filing documents with NDS does not mean a return has been completed, approved by you or submitted to the Canada Revenue Agency or another authority.

6. Current law and jurisdictions

Rules, rates, forms, deadlines and government guidance change and may differ between Canada, provinces, the United States, Australia, the UAE, Singapore, India and other jurisdictions. Publication and “last updated” dates do not guarantee that every item remains current. Check official sources and obtain advice in each relevant jurisdiction.

7. Client responsibility

You remain responsible for providing complete, accurate and timely information; disclosing relevant facts; reviewing advice, returns and filings; approving submissions; retaining original records; meeting deadlines; and deciding whether to act. Notify NDS promptly of errors or changes. NDS is not responsible for consequences of missing, misleading, incomplete or late information.

8. No guarantee

NDS does not guarantee tax savings, refunds, financing, valuation, regulatory acceptance, government processing times, dispute outcomes, business performance or any other result. Government authorities and third parties make their own decisions and may request information, reassess, audit, reject or delay a matter.

9. Third-party and AI information

Links, integrations and references to government or third-party services are provided for convenience and do not constitute endorsement or control. Automated or AI-assisted features, if offered, may produce incomplete or inaccurate output and must not be treated as a professional conclusion without NDS review under an engagement.

10. Contact

For advice about your circumstances, submit an inquiry so NDS can determine whether to accept a defined engagement. For legal concerns about these notices, NDS should consult qualified Canadian counsel.

11. No guarantee of outcome

NDS does not guarantee any tax result, refund, assessment, audit outcome, CRA or IRS acceptance, or processing time. Tax authorities may interpret facts and law differently. Estimates and calculator results are illustrations only and may differ from final assessed amounts.

12. Client responsibility

You are responsible for the completeness and accuracy of the information and documents you provide, for reviewing and approving every return before filing, and for retaining your own records. NDS relies on information provided without independent audit or verification unless expressly engaged to do so.

13. Limitation of liability

To the maximum extent permitted by applicable Canadian law, NDS, its directors, officers, employees and contractors are not liable for any indirect, incidental, consequential, special or punitive loss, lost profits, interest, penalties or damages arising from use of, or reliance on, the website, portal, calculators or general information. For accepted engagements, total liability is limited to the fees paid for the specific service giving rise to the claim, except where such limitation is prohibited by law.

14. Governing law

This Disclaimer is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Nothing in it limits any right that cannot be limited under applicable consumer protection law.
